Alika, a Washington state native, earned his Bachelor of Arts in Law and Justice from Central Washington University before pursuing his Juris Doctorate at Thomas M. Cooley Law School, where he graduated cum laude.

Answers to Common Personal Injury Questions

Am I suing my employer if I file a workers' compensation claim?

No. If you file a worker's compensation claim, then you are filing a claim with the employer's worker's compensation insurance carrier. You are not suing your employer.

How long do I have to file a workers’ compensation claim?

You must notify your employer of the accident and injury within 7 days and see a doctor within 90 days of the accident. It is the completing of a C-4 form at the initial doctor visit that starts the workers’ compensation claim process.

What happens after I file a workers’ compensation claim?

The workers’ compensation insurance company has 30 days from the date the C-4 form was submitted, by the doctor, to accept or deny the claim. During this time the worker's compensation insurance company will investigate the claim.

How long will my case take?

Every case is different, but personal injury and workers’ compensation claims can take a few months to over a year, depending on complexity and negotiations.

 Can I still file a claim if I was partially at fault for the accident?

Yes! Nevada follows a modified comparative negligence rule, meaning you can still recover damages as long as you were less than 50% at fault.

What should I do after an accident or injury?

Do you need an attorney after a car crash?

You need an attorney when you are involved in an accident. You want to reach out to an attorney as soon as possible. Each day that goes by without proper representation means that your potential case could suffer.

How long after an accident do you have to hire an attorney and file a claim?

In Nevada, you have two years to make a claim. However, you always want to hire an attorney right away. There are a lot of moving parts after an accident occurs and it can be very confusing and stressful.

You want someone to guide you through the entire process. At Angerman Law, we do just that. We handle everything for our clients so that they can focus on treatment and getting better.

Can I get paid if I cannot work?

Yes. If you miss more than five (5) consecutive days of work, because of your injury, you may be entitled to temporary total disability benefits.

Should I hire a workers’ compensation lawyer?

Yes. Even though you may handle your case on your own, the worker's compensation insurer WILL have a team of attorneys consulting and representing the insurer and even employer's interests in court. You should have an attorney that is experienced and specializes in worker's compensation law.

What does a workers’ compensation lawyer charge if I sign the contract?

The industry standard is 33 and 1/3% for any PPD settlement/award and retroactive benefits. This amount may differ depending on the amount of effort and time involved with an individual claim or issue. However, there is NO FEE unless we win.

What if the insurance company offers me a settlement?

Insurance companies often offer lowball settlements to save money. Never accept an offer without consulting a lawyer—we’ll fight to get you what you truly deserve.

How long after an accident do you have to seek treatment?

There is no set time frame to seek out medical attention.  However, if you are injured, you would want to get medical attention as soon as possible.  

It is important to contact Angerman Law as soon as an accident occurs, so that we may assist in getting you to the proper medical providers, even if you have no health insurance.  

The insurance companies look for any excuse to not compensate you. Any delay in treatment will give the insurance company the impression you must not have been injured since you did not go to the doctor right after the accident.

I am a tourist. Can I get representation in Nevada?

When in an accident, you will want to hire an attorney that is licensed in the state. For example, if you are a resident of California but were involved in an accident while visiting Las Vegas, Nevada, you would want to hire an attorney licensed in Nevada.

That attorney will be familiar with the laws of that state and should also be able to assist in getting you to the proper medical providers when you return home.  It is also a good idea to reach out to Angerman Law as soon as possible, so we can advise you on what may need to occur before you return home from your vacation.
